Increased Limits on Denied Boarding Compensation, Domestic Baggage Liability Limits, and Civil Penalty Amounts

On May 27, 2015, DOT announced higher maximum limits on certain “Passenger Protections” and on civil penalty amounts that DOT may impose.  The new limits take effect on August 25, 2015.  The limits are reviewed every two years and are adjusted to reflect changes in the Consumer Price Index for All Urban Consumers (CPI-U). 

This Final Rule will:

  • Raise maximum denied boarding compensation (DBC) amounts on domestic and international flights from the current amount of $650/$1,300 to $675/$1,350.

  • Raise the minimum liability limit air carriers may impose for mishandled baggage in domestic air transportation from $3,400 to $3,500. 

  • Raise maximum civil penalties that can be assessed as result of DOT aviation enforcement actions for violations of section 41712 or consumer protection rules or orders by small businesses and individuals from $2,500 to $2,750.
