On September 10, 2013, the Federal Aviation Administration (FAA) republished its Policy Regarding Airport Rates and Charges (the “Policy”) in order to reflect the many amendments and deletions that had occurred since it was originally published on June 21, 1996.

FAA IMPLEMENTS STAGE 3 NOISE REQUIREMENTS
The Federal Aviation Administration (FAA) has published a Final Rule which implements noise provisions that were written into the FAA Modernization and Reform Act of 2012 (“the Act”). Section 506 of the Act prohibited jet airplanes weighing less than 75,000 pounds from operating in the contiguous United States after December 31, 2015 unless they meet Stage 3 noise levels. The Act has been codified into law at 49 U.S.C. § 47534.
COMMUNITY AIR SERVICE PROGRAM GRANTS
The DOT has announced that it is inviting communities and/or consortia of communities to apply for a federal grant under the Small Community Air Development Program (“Small Community Program”). The Small Community Program is designed to assist small communities to enhance their air service.
FAA CLARIFIES POLICY ON NON-CITIZEN TRUSTS
Today, FAA issued a Notice of Policy Clarification for the Registration of Aircraft to U.S. Citizen Trustees in Situations Involving Non-U.S. Citizen Trustors and Beneficiaries. The policy, as clarified, is effective September 16, 2013.
After a series of public meetings with stakeholders and consideration of written comments from interested parties, the clarified FAA policy states that:
FAA RESUMES NORMAL OPERATIONS
Today, FAA announced that is has suspended all employee furloughs. Air traffic facilities will begin to return to regular staffing levels, and the system will resume normal operations by April 28, 2013.
